For videos with audio is the site going to treat them identically to those without audio when a user loads one up? The reason I ask is because the audio could cause problems for users if they weren't expecting audio or the audio volume is too loud on the video. I also am concerned about if looping is defaulted on those videos, something like this (dropbox link) would get rather annoying with the looping on by default for it.

That's why there's a thumbnail icon for ones that have audio. Also a tag if you want to blacklist it.

That doesn't really answer the issue on volume though, nor does it answer my question on if they're looped. It also doesn't take into consideration being linked to the post, so never seeing the icon.
Autoplay for videos with audio should probably be off and looping should either by default be off or set as an option when uploading the video.

Uploading short clips from anime is fair use I think. Already a number of those on Danbooru, and tons on Youtube, as well as other sites.
It might be better to make it clear in the ToS and upload guidelines, before someone gets a bright idea to upload entire anime episodes in 2 minute chunks. Also, I think that entire openings/endings are taken down on youtube, and they fit in 2 minutes just fine.

There's nothing you can do about volume. Different videos just have different volumes.
Could make it so videos without sound loop and videos with sound do loop.
It might be a good idea to set the HTML <video> element to muted by default (i.e. the video plays immediately but sound will be only played if you activate it), see https://developer.mozilla.org/en-US/docs/Web/HTML/Element/video#attr-muted

about:on-topic talks about this but I never thought about it that far when discussing about revising the ToS.
