Is Kirby cosplaying?

How should it be tagged when Kirby has the likeness of another character? copy ability? cosplay? both? it depends?

There's just so much inconsistency here.

Maybe copy ability and cosplay for characters from other series, and just copy ability for in-universe?

Which universe though. If an image is parodying smash could still be ambiguous.

I have no idea who Kirby is other than a round pink ball or what he does for a living even though I still upload pics of the little bastard whenever I find them, so I think such a clause would be pretty bad, because it'd be impossible to follow for someone not familiar with the copyright. If it looks like cosplay...

It depends. If he's swallowed some pyrokinetic character but all he does is turn red and breathe fire, then obviously not. But if he gains some of their physical attributes, then yes, absolutely. Being a copy ability shouldn't disqualify it from being cosplay.
