Wasn't that Germany's decision? The Tripartite Pact only stated the powers would defend each other in case any one of them were attacked.
Actually Hitler was the one who urged it because several actions made by the US provoked him, he just used the pact as an excuse and force Germany to declare war against the US. Everybody knows that if Germany declares war with the US while haven't done dealing with the Soviets, will lead to nothing but disastrous results. Hitler also knows it but can't help it, he just got over confident until trouble escalates which marked his defeat.
And Churchill was surely thankful about that now that the Americans officially entering the war.

They didn't need to send anyone to spy. The general feeling in America before Pearl Harbor was in one way, the same as before her entry even in WWI.

The US did not want anything to do with the conflict engulfing Europe nor in Asia. FDR had just enough support to send aid to China and the British. But actual military commitment and open war? Hell no, most Americans didn't want that. Americans were sympathetic to their plights but enough to a point to go to war? No.
Japan attacking Pearl Harbor changed that, and Germany was forced to declare war on the U.S. to support a Tripartite Pact member and making official to the gray area of fighting going on in the Atlantic as U.S. convoys shipped war material to the U.K., even involving fighting. But "unofficial fighting with convoys" is far different from full, open war as nations commit to that.
Still, Germany already had its hands full. The British were never subdued and presented problems in every compass direction except in the East. But in the East, Germany was knee deep in the early stages in its war with Russia. Then it made it official to go to war with the U.S. and be amazingly at war with the largest industrial, economic powers all at the same time (U.S., U.K., USSR, etc), with one of its own allies so distant that assistance and cooperation between them was impossible.

Pearl Harbor was completely unrelated to Germany's declaration of war, especially according to the declaration itself which was really just a confirmation that they were and have already been at war.
